Mr. Ali H Dagher
Born in Sierra Leone, attorney Dagher immigrated to the U.S. in 1978. He received his Bachelor of Science degree in Business Administration from the University of Michigan-Dearborn and his Juris Doctorate from the University of Detroit School of Law in 1992. Mr. Dagher is fluent in Arabic and is familiar with multiple aspects of trade and commerce in the Middle East and North Africa Region (MENA). His experience and relationships in these regions have proven valuable to his clients.
Ali H. Dagher is a member of the Michigan Bar Association and the American Bar Association and is host of weekly radio show on CINA Radio (102.3 FM in Windsor, Canada and Detroit, Michigan) called “Talking Real Estate.” In addition, attorney Dagher is the owner of Detroit Title & Escrow Company with two offices in Detroit and Dearborn, Michigan.
As a Founding Member and former Chairman of the American Arab Chamber of Commerce (AACC) and Co-Author of Founding Proposal in 1990, Mr. Dagher is a 35-year activist in the Detroit area business community. Attorney Dagher remains a Board Member of AACC and is also member of the following Boards and Commissions:

Commercial Contract Disputes

In the development of our strategy, we thoroughly discuss with the client the various options afforded by the law including money damages and equity pursuant to Michigan/Federal law and the Michigan/Federal Court rules while providing solid advice to avoid the costly wastes of resources.
Four Common Equitable Actions
Employment Covenants Not-To-Compete
Michigan law (MCL 445.774a) allow employers to obtain from employees a covenant or agreement to protect the employer’s reasonable competitive interest. The reasonableness standard is directly related to specific subject matter of the employment along with specific duration and geographic limits. At Dagher Law, we weight all our client’s option to get the best results that makes business sense.
Enforcement of Specific Performance of Real Estate Sales Contracts
Generally, specific performance is a remedy that allows a Plaintiff to obtain equitable relief when there is no adequate amount of money that would allow relief to the plaintiff. To succeed in obtaining specific performance, the Plaintiff must have a valid and enforceable agreement. Because real estate considered “unique” under Michigan caselaw, the enforcement of a specific performance agreement is possible so long as all other standards of equity are met including (1) Plaintiff having “clean hands” and the remedy being sought is not lobsided and is fair to the parties. This type of action cannot be determined by a Jury, and it has a six-year statute of limitations. At Dagher Law, we plan and execute every aspect of these cases to achieve our client’s objective with diligence and efficiency.
Quiet Title Actions After Tax Foreclosure
Upon the purchase of property from the County Tax Auction, a buyer receives a Quit Claim deed and not a warranty deed. As such, the purchaser should file suit to quiet title against all parties of interest going back as far as 50 years to be able to obtain an insurable title. In Michigan, MCL 600.2932 allows the purchaser to and seek equitable relief from the Circuit Court. Such a suit must include all parties of interest. This process can become complicated in lieu of the fact that parties of interest may have died or are difficult to locate. Having the necessary experience on how to in deal with these types of cross-legal disciplines is critical. At Dagher Law, we have been bringing these actions for over 15 years in the Michigan Circuit Courts.
Declaratory Relief Actions
These actions are a form of equitable actions. In commercial litigation this type of action is brought to seek a “declaration” from the Court about whether a contract (such as a Fuel Product Supply Agreements) can be terminated. This type of action can be commenced even while the parties are fulfilling their obligations under the agreement. At Dagher Law, our experience attorneys we will expend all efforts necessary to seek justice under the law.
Shareholder/Membership Disputes: Breach of Fiduciary Suits
Litigation Among Members and Shareholders of a Company
Members/shareholders of companies in Michigan and other states have a fiduciary obligation to act in the best interest of the Company and other members/shareholders of said company. The elements of the fiduciary obligations include (1) loyalty; (2) care to the extent that their duty must be discharged with reasonable skill or care that a reasonably prudent person would use under the circumstances, (3) honesty, and (4) must act with the utmost good faith to further the principal’s interest. A breach of any of these obligations creates a liability on the part of the breaching party. At Dagher Law we will protect and defend your rights under the law from predatory shareholder or members.

Landlord-Tenant Litigation
There are two principal Michigan statutes that govern Lease Agreement and Landlord/Tenant litigation including: (1) Summary Proceedings Act which gives jurisdiction to the District Court to litigate all cases under $25,000 and possession of premises; (2) The Forcible and Detainer (anti-lockout) Act). At Dagher Law, we approach all Landlord/Tenant litigation keeping in mind costs and strategic objectives intended to make our clients whole.
Family Law
Divorce under any circumstances is a matter that cannot be taken lightly. At Dagher Law our objective is to position our client with all available advantages to help in this difficult transition. Prior to filing, it is our policy to discuss and prepare the client for as many matters that are likely to arise so that we can fight for all the client’s interest whether involving assets or the children or the enforcement of either a pre-nuptial or post-nuptial agreement. Estate Planning
The most common tool in estate planning is a living trust. Such a trust has many advantages when it comes to preserving assets. While trusts can eliminate or reduce estate or “death” taxes and assist in avoiding probate or the need for a conservatorship, they may not be ideal for everyone. Instituting a living trust requires thoughtful, detailed work for the couple or individual, and maintaining it must be considered as well.
